THE CANONBURY'S LICENCE APPLICATION -
DEADLINE FOR YOUR VIEWS: THURSDAY 30 JULY 2009
The landlord of The Canonbury has put in an application for a new licence. The Council will rule on the application at a hearing scheduled for 10 August 2009. This is your last chance to let the Council know your views on The Canonbury’s application.

The letter must arrive by Thursday 30 July. If delivering by hand to 222 Upper Street ring extension 3031 and wait for someone from licensing to collect your letter or it may go astray.
The Council has very specific criteria that it follows when assessing licensing applications so please try and include some of the following categories in your letter:
Prevention of Public Nuisance (In law this is an offence in which the injury, loss or damage is suffered by the local community as a whole rather than by individual victims)
Prevention of Crime and disorder
Protection of children from harm
Public safety
Please note that the licence is concerned primarily with the points covered below. The Canonbury will shortly be submitting a retrospective planning application for the changes made to its garden. The Council will ask for comments from the local residents regarding this application in due course.
DETAILS OF THE NEW LICENCE APPLICATION
Opening hours: Pub to be open every night, 7 days a week, until midnight Garden to be open until 10.30 pm
Comments: These conditions are the same as in the previous license - however, the pub is now much bigger so it is likely that there will be more noise and disruption at night as people leave the pub and walk home/go to their cars. We would like the opening hours for the garden to be until 10pm, and for the pub to be 11pm - which is consistent with the Marquess and the Albion and more appropriate for a residential area especially given the increased numbers of people.The earlier closing would also hopefully cut down on drunken crime and disorder late at night.
Music:The Landlord has applied to play recorded music in the garden.
Comments:This will increase the overall noise and nuisance. We would like amplified sound forbidden in the garden.
Temporary Events: The Landlord is asking to have up to 22 'temporary events' each year - these are events where licensing conditions do not apply. These events can last for up to 72 hours and the only people who can object are the police. Again this is likely to lead to nuisance, wake the children in the area and cause general disruption in what is predominantly a residential neighbourhood.
Comment: We will push for the number of Temporary Events to be reduced to 12 (which is the statutory minimum).
Seasonal restrictions on use of garden: The Landlord wants to remove the seasonal restriction on the use of the garden - the previous license required that the garden be closed at the same time as the Canonbury Square gardens from 1 October to 30 April each year - this obviously provided a natural limit on the garden use.
Comments:We think this condition should continue in full force - it has been on the license since at least 1964 and provides a natural constraint on the use of the garden. Barbecues: The Landlord wants to have barbecues Wednesday to Sunday inclusive until 9pm .
Comment: Neighbours of the pub have complained previously of thick smoke blowing into their homes and gardens and also the cooking smells from the barbecue. The Canonbury has plenty of indoor cooking facilities and it is not necessary to inconvenience neighbours further by having an outdoor barbecue.
Children:The Landlord wants to permit children in the garden supervised by adults until 9.00pm.
Comments: We do not have any objection to this providing they are well behaved and there is proper supervision.
Other people are concerned about the extent of the light pollution now that The Canonbury is lit up so strongly at night.
